Terms & Conditions
These terms and conditions shall apply to all orders for goods received by EAT NANO. No other conditions whether or not inconsistent with these conditions shall apply. It is very important that you read and understand them. These conditions do not affect your statutory rights. These terms and conditions are subject to change without notice and supersede all previous editions.
Acceptance of Orders
All orders are accepted by EAT NANO subject to these conditions of sale. No variation of these conditions will be accepted unless previously agreed in writing by the Managing Director of EAT NANO. Orders will only be binding upon receipt of written confirmation from EAT NANO, who reserves the right to refuse any order. In the event of any pricing error occurring within this website, within any fax or e-mail correspondence however received, all incomplete orders shall be deemed void.
Customer’s Authority
Customers entering into transactions with EAT NANO expressly warrant that they are authorised to accept and are accepting these conditions not only for themselves but also as agents for and on behalf of all other persons who are, or may become, interested in EAT NANO’s goods or products, whether in whole or part.
Payment
We accept online payment through Paypal. We do not store credit card details nor do we share customer details with any 3rd parties. If you are shopping from outside the Euro zone, place your order and your credit card company or bank will convert the transaction to your own currency. Payments can be accepted in Sterling Pounds. Trade / Wholesale customers may pay by credit/debit cards only at time of placing an order. Trade / Wholesale customers can apply for a credit limit, EAT NANO will assess your company details and provide you with the appropriate credit limit and time based on trading history. Otherwise invoices must be paid by credit card at the time of purchasing. All orders for goods are subject to stock availability. If we do not supply goods to you for any reason, we will inform you of the situation and will not charge you for those goods, and will refund any money already paid by you for these goods. We are not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to us in lieu of an un-fulfilled order.
Prices
All prices quoted or displayed are in GB Pounds at the time your order is placed. We are entitled to make adjustments to the price to take account of any increase in, or the imposition of new taxes or duties. If due to an error or omission the price published for the goods on our website is wrong, we have the right to terminate an order provided the goods have not been dispatched. We will try to ensure that all prices displayed on our website are accurate, but should an error occur, we would inform you of the correct price and give you an opportunity to cancel the order. Please note that the prices quoted are subject to availability and EAT NANO reserves the rights to refund the payments to you if the database processes your order in error. Every effort will be made to maintain a stable supply and pricing policy subject to market conditions and variations. EAT NANO reserves the right to alter prices without notice explanation or notification. We will be pleased to confirm our latest prices by telephone.

Care has been taken to convey the exact details and specifications of the products. EAT NANO reserves the right to alter details and specifications without notice explanation or notification. Some photographs / graphics on the website are for graphical purposes only and may not be of EAT NANO foods itself.
Retention of Title
All goods supplied by EAT NANO to the customer shall remain the property of EAT NANO until such time as EAT NANO receives payment in full for the goods and of all other monies due to EAT NANO from the customer. Until such payment as aforesaid is received, the separate identity of those goods shall be maintained by the customer. After delivery of the goods to the customer or his nominated sub-purchaser, the goods shall be at the customer’s risk and the customer shall insure those goods against loss or damage.
Until such time as title in the goods shall pass to the customer in accordance with the foregoing provisions, EAT NANO shall be entitled at any time to repossess the goods whether with or without notice and EAT NANO and its employees or agents shall have the right at any time to enter upon the premises of the customer for the purpose of effecting such repossession.
Force Majeure
EAT NANO will not be liable to you for any failure or delay in performance of our contract, if it is due to an event beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.
No Warranty
Goods are supplied according to the descriptions and specifications given by the manufacturer. EAT NANO and its employees or agents are not authorised to make any representations concerning the goods unless strictly confirmed in writing. In entering into this agreement you acknowledge that you do not rely on any such representation to complete your purchase with us. We make no warranty as the suitability of any goods for any particular purpose. Health Foods are not medicines, thus EAT NANO cannot and are not authorised to guarantee results. In entering into this agreement you acknowledge that there are no guarantees for the purpose of the goods.
Deliveries
Every effort will be made to supply orders promptly. EAT NANO will not accept responsibility for suspension or delay in deliveries or for the consequences thereof. In general the price quoted is for delivery to the reception desk and/or ground floor at the stated delivery address. We use DPD to deliver our goods depending on the size, value and destination of your order. We aim to dispatch all orders the following working day. EAT NANO takes a certificate of posting from our courier providers for all dispatched goods. A signature may be required at the time of delivery. EAT NANO will not accept responsibility for suspension or delay in deliveries nor for the consequences thereof once the goods have left our premises by any of our nominated carriers. Free Delivery is offered to UK customers who place an order to a UK address. Free Delivery is available for orders more than €19.99.
Back Orders
If your item is not in stock, we will back order it for you. You will always be emailed with the option to cancel your order if you would rather not wait.
Receipt of Goods
Receipt of Goods should be signed for as “unexamined”. It is the responsibility of the recipient at the customers’ premises or on behalf of the customer to count and check that all boxes and goods that are delivered are as per the accompanying delivery note. Any damages or shortages must be reported immediately by phone and in writing within THREE working days of delivery, otherwise no claim will be considered. The complete packaging must be retained if pilfering is suspected or if breakage has occurred. Shortfalls cannot be rectified if these procedures are not strictly adhered to.
Non-Delivery
An invoice or receipt is usually sent together with the goods or a day after the goods have been dispatched. Most of our goods are dispatched on a next day basis. In the event of non-arrival of goods, customers must inform EAT NANO within FIVE days of the invoice date, otherwise no claim will be considered.
Proper Law
All contracts made with EAT NANO shall be governed by and construed according to the English Law and the purchaser submits to the jurisdiction of the English courts. These terms of trade will prevail over any conditions that shall be issued by the customer. The customer should not rely on any representations made by staff as they do not form part of the contract or collateral contract.
